3. Payment Terms
Services are billed according to agreed proposals or retainers.
Payments must be made on time as stated in invoices.
Late payments may result in paused services.
Fees are non-refundable unless otherwise stated in writing.
4. No Guaranteed Results
While we aim to deliver measurable growth, we do not guarantee specific revenue, ROAS, or performance outcomes.
Marketing performance depends on multiple factors including:
Market conditions
Competition
Product-market fit
Budget allocation

6. Intellectual Property

Scale95 retains ownership of proprietary systems, strategies, and internal processes.
Marketing materials created for clients may be used in portfolios or case studies unless otherwise agreed in writing.

Scale95 shall not be liable for:
Loss of profits
Indirect or consequential damages
Platform bans or policy changes beyond our control
Third-party service interruptions
Our liability is limited to the amount paid for services within the last 30 days.

Outstanding payments must be settled upon termination.
